Organized Under provisions of an act authorizing the incorporations of Rural Cemetery Associations Vol 2d P.P. 625 of Revised Statutes of State of New York
Meeting of the citizens of Tonawanda Erie Co N.Y. and also of the citizens of North Tonawanda Niagara Co N.Y. having met at the Council Room of the village of North Tonawanda Niagara County N.Y. pursuant to notice.
Present Hiram Newell Jacob Becker Edward [P.?] Oyer George Becker David Robinson Elias P. Browne Charles [C.?] Harris George W. Sherman Benjamin F. Felton George [Pirry?] Franklin Warren Whitman Jacobs Lewis S. Payne Garwood L. Judd
On motion Hon Hiram Newell was appointed President and Garwood L. Judd Secretary.
It was moved and carried that we do now form an association under and by virtue of the Statute, & known by the name of the Col John Sweeny Rural Cemetery Association.
It was moved & carried that six Trustees be elected to compose a board of Trustees of said cemetery.
The following named gentlemen

Meeting called to order by the President and the following business transacted.
The Secretary presented a deed of a certain portion of land known as the Col John Sweeney Rural Cemetery grounds which was given to this Association by the heirs of Col. John Sweeney.
On motion the aforesaid was accepted and the Secretary was requested to have the same recorded in the Book of Deeds in the Niagara Clerks Office.
On motion Hon Hiram Newell was appointed Superintendent of the Cemetery grounds.
On motion G. L. Judd Esq was appointed a committee to procure a statement of all moneys received or paid out for Improvements upon said Cemetery grounds previous to the present time.
On motion the Secretary was appointed a committee to ascertain persons who
Source 10who have possession of certain lots in said Cemetery Grounds and ascertain the amounts due for said lots & have been paid by them.
On motion the Secretary was directed to procure such stationery as may be required for the use of this association.
On motion it was Resolved that no burials will be allowed within the Cemetery Grounds without the written permission of Superintendent — and that the Secretary notify persons interested of the said resolution.
On motion the office of Seldon [G.?] Johnson was chosen as the office of the association and decided that all meetings should be held at that place.
On motion the board adjourned until July 2nd at 8 Oclock P.M.

On motion Mr John Simpson was appointed a committee to procure a suitable set of stairs to be placed in the south west corner of the Cemetery grounds for the purpose of Entering the Cemetery.
On motion the Secretary was requested to report a form of Rules & Deeds & submit the same at the next meeting.
On motion the meeting was adjourned to Thursday July 9th 1868 at 8 Oclock P.M.

Minutes of last meeting not present therefore were not read.
G. L. Judd reported that he had received a written statement of H. P. Smith & the N.Y. & Erie Bank which was received to be acted upon by the board when called up.
On motion the Superintendent was instructed to employ Franklin Warren and other men to clear the walks and avenues in the Cemetery and the amount of labor expended for such purpose shall not exceed the amount of One Hundred Dollars.
On motion it was Resolved that the President and Treasurer be requested to execute Deeds of lots to all parties who will pay for their lots and collect the money for the same untill the next meeting of this board.
On motion the meeting was adjourned untill July 23rd at 8 Oclock P.M.

Meeting called to order by the President and the minutes of the meetings of July 2nd and July 9th were read and approved.
The committee upon Rules & Deeds reported and on motion the form heretofore used were adopted.
The Committee appointed upon title to lots reported persons who had not paid & those who had paid for their lots as far as could be ascertained.
In pursuance of motion authorizing the President & Treasurer to issue Deeds to Capt Chas Kelley Lot No 2 Section E for the sum of $25.00.

The Supt of the Cemetery reported an expense of 28 days labor to amount of $60.00. Said report not including the services of F. Warren.
Also sundry Expense to amount of $9.00 for Stakes & Lettering.
Source 14On motion the President was appointed a committee to collect moneys due for lots &c till the next meeting.
On motion it was resolved that the sum of ten (10) Dollars be added to the present price of money due on all lots for amount of expenditures for Stamps &c which accrue from the renewal of the new Deeds.

On motion the President and Vice President were authorized to sell & Receive money for the payment for lots and issue the proper Deeds therefor.
On motion the President be authorized to issue a Deed to Elder Joshua Vincent for lot No 2 Section A for amount of $15.00.
On motion the meeting was then adjourned.

On motion an order was directed to be drawn on the Treasurer in favor of Hiram Newell Treasurer for the amount of Eighty Three 84/100 Dollars for bill rendered.
On motion an order was directed to be drawn on the Treasurer in favor of Franklin Warren for the amount of Twenty Seven Dollars for labor as per Bill rendered.
On motion an order was directed to be drawn in favor of John Simpson
Source 16to the amount of fourteen 68/100 Dollars as payment for building steps & for lumber for the same as per bill rendered.

On motion the superintendent was authorized to open and clear such avenues as he may deem Expedient at the present time.
On motion the secretary was directed to notify the individuals who occupy lots unpaid for — that they must pay for the same or remove the bodies deposited upon the lot.

The subject matter of persons rendering services unpaid for upon the cemetery grounds was presented and the following bills

The Secretary was directed to notify H. P. Smith that an order was directed to be drawn in his favor for amount of $21.87 and upon his paying to the Treasurer the amount of $58.13 Deeds of lots No [blank] Section [blank] would be given to him.
On motion the President was directed to Enforce compliance with resolution heretofore made upon persons occupying lots unpaid for.

Also reported the following disbursements Paid L. S. Payne for Recording in Niagara County Clerks office [“Three ($3.00) Dollars” struck through] the articles of Association and Deed of Grounds &c the sum of Three ($3.00) Dollars & for Stamps $5.00.
On motion Saturday the 20th day of Feby 1869 at 2 Oclock P.M. was designated as the time for the Election of officers in place of G. L. Judd Esq & Hiram Newell Esq whose Term of office expired at that date.

On motion it was resolved Whereas in consequence of the day for the annual election of the board of Trustees having passed and that said Election did not take place: it was Resolved that G. L. Judd Esq be hereby authorized to transmit to all Lot owners a written notification that a Special Election would take place at the office of S. [G.?] Johnson on the 11th Day of March 1870 for the Election of two (2) Trustees in place of B. F. Felton and John Simpson.
On motion the board adjourned to meet at the office of S. [G.?] Johnson on March 11th 1870.

The Sup of the Cemetery grounds made his report and presented his account the details of which may be found in the Books of the Treasurer. The total amount of disbursements during the year by him was $100.38.
And on motion it was allowed and orders were directed to be drawn on the Treasurer for the amount.
Hon Hiram Newell Treasurer presented his financial report as follows

The time having arrived for the Election of two Trustees in place of B. F. Felton and John Simpson the Election was proceeded with and J. Freeman Vincent and Dr Conrad Backer were duly Elected as Trustees for the Term of Three years from Feby 1st 1870.
The board then proceeded to organize their respective officers for the ensuing year which resulted in Electing

Which was accepted and on motion an order was drawn on the Treasurer for amount.
Mr S. [G.?] Johnson asked the privilege of exchanging his lot for one in Sect B. to be hereafter selected.
By a motion made and carried the President & Secy were authorized to take up the old deed of the lot now held by Mr Johnson and give him the lot he may select he paying the difference if any.
On motion Mssrs Vincent & Backer were appointed a committee to confer with & settle the

On motion the Secty was directed to notify all persons that have their dead on lots unpurchased to remove the same between this date and the first day of November next or the same would be removed by the board.
On motion Dr C. Backer was allowed to exchange Lot 12 for Lot 14 by paying difference in price of the two Lots.

Minutes of last meeting not being at hand on motion the reading of them was dispensed with.
Mr James Carney presented his resignation which on motion was accepted and Mr Simon Bellinger appointed in his place.
Motion made and carried that Mr G. L. Judd be allowed to exchange his deed of Lot 1 & have deeds of Lots 1 & 2 in Section “G” by paying difference of price.
On motion the Supt was authorized to use Lots [blank] in Section F (N.E. corner of the cemetery) to bury the bodies in that are now in the Streets & on Lots unpaid for. And the Treasurer was also authorized to pay bills for

At the annual Meeting of the board of Trustees of the Col John Sweeney Rural cemetery. Present Doct. Backer President, S. G. Johnson & G. L. Judd Trustees. The Treasurers Report was read and accepted. The amount received from former Treasurer Hiram Newell was the Sum of $307.88 & received since he came into office (S. G. Johnson) $142.25 in all $514.13 and paid out 5.00 for Stamps leaving in his hands $509.13.

It was moved and carried that Frank [Young?] have a deed of his lot for the money he has paid to George Wing as per order of James Sweeney. It was moved that the Treasurers report be received as read. On motion the association proceeded to ballot for Trustee in place of G. L. Judd, which was done whereupon G. L. Judd was declared duly Elected as Trustee in place of G. L. Judd and
Source 34Simon Bellinger was declared duly Elected in place of Hiram Newell. On motion this meeting do now adjourn Sine a die.
February 1872
At a meeting of the board of Trustees of the Col John Sweeneys Rural cemetery held at the office of S. G. Johnson. Present Trustees Messrs — Backer S. G. Johnson G. L. Judd F. Warren and Simon Bellinger. It was moved that Doct. Backer be our President for the ensuing year. F. Warren Vice President S. G. Johnson Treasurer and G. L. Judd Secretary. It was moved & carried that S. G. Johnson receive fifty cents for Each deed drawn by him on presenting his bill. He presented his bill for drawing Sixty deeds which was allowed at $30.00. On motion a bill of G. L. Judd for acknowledging Deeds be allowed at $13.75. And on motion a bill also of George M. Warren of $1.00 for acknowledging Deeds was

1873 Col John Sweeney Rural cemetery association Room Feby Feby 5, 1873.
At an annual meeting of the stock holders of the cemetery convened at the office of the secretary on the 5th day of February 1873 gentlemen present Doct Backer Freeman J. Vincent Simon Bellinger G. L. Judd & S. G. Johnson Trustees. Minutes of the last meeting read and approved. S. G. Johnson read his report which read from the Treasurers Book and found in his hands the Sum of $740.98.
On motion the board do now proceed to Ballot for Trustee in place of Doct Backer and Freeman J. Vincent. Which was duly done by ballot and Doct Backer & Freeman J. Vincent were duly Elected. S. G. Johnson tendered his resignation as Trustee which was duly accepted. Simon Bellinger [“of” follows; intervening words apparently omitted] $14.25 duly presented and allowed and bill placed on file.

Judd was duly Elected Secretary for the ensuing year. It was moved & carried that the Treasurer B. H. Neff Give the requisite Bail for safety of the money of the corporation.

The Treasurer B. H. Neff presented his report, which Shows he had received from S. G. Johnson former Treasurer $740.98 and received from other sources $191.50 making the gross amount of $932.48 and paid out since last report $353.52 leaving in Treasurers hands $578.96.

Bellinger Esq for the purpose of Electing Two Trustees in place of Dr Backer and Freeman Vincent, whose term of office Expires on the first day of Feb 1876.

On motion Freeman Vincent be Ballot for Trustees. Freeman Vincent was duly declared unanimously Elected Trustee and on Motion of Backer George H. Smith be Elected Trustee. George H. Source 52Motion made and duly seconded that Dr Backer [inserted in place of “the Treas”] be authorized to notify those who are in arrears for payments on Lots that they must pay up all accounts within 30 days — or Legal proceedings will be commenced. Carried.
On motion the Treasurer was instructed to give to Dr Backer a list of those who are in debt for Lots to enable Dr Backer to know who are in arrears.
On motion Mr S. Bellinger was elected as Superintendent of the Cemetery for one Year and allowed a Salary of $25.00 for the year.
On motion Mr S. Bellinger was allowed $25.00 for his services for the year just past and that an order be drawn on the Treasury for the amount.

The chairman stated that this was the annual meeting of the lot owners of the association and it was necessary to elect two trustees in place J. F. Vincent & Geo P. Smith whose term of office had expired.

A ballot for trustees was had which resulted in the election of J. F. Vincent & A. G. Kent for the term of three years.

The following resolution was offered Resolved that there be erected on a suitable place inside the enclosure of the Cemetery, a building about 10 x 14 and about 8 ft high, made of good dressed lumber & painted, to contain the necessary tools & implements used in the cemetery. Carried.

Motion was made and carried that the Lot owners proceed for two Trustees in place of Franklin Warren and J. Freeman Vincent who term of office expired.
On Ballot being taken for Trustees Franklin Warren and J. Freeman Vincent were duly elected Trustees for the ensuing three years.
On motion the Proceedings of this annual meeting and the report of the Treasurer be published in the Tonawanda Herald.
Motion was made and carried that the President of the incoming board be instructed to call a meeting of the lot owners of the Cemetery Assn by publishing notice of said meeting in the Tonawanda Herald two weeks previous to said meeting upon a written request of five lot owners - said meeting to be for the purpose of acquiring - or taking the necessary measures to acquire lands for the enlargement of the present cemetery grounds.

The President stated that the meeting was called for the purpose of taking action regarding of removing dead bodies from the cemetery. On motion of E. B. Simson & seconded by A. A. Simson That any person desirous of removing a dead body from The Col. Jno. Resolved that as trustees of this Association we favor the condemning of Thirty Three feet of the north end of the Cemetery for the purpose of widening Thompson Street between Payne Ave and Bryant, upon the condition of the heirs of Colonel John Sweeney conveying to the Colonel John Sweeney Rural Cemetery Association the private cemetery ground located in said Rural Cemetery between Longs Ave on the north, Johnson Ave on the east, Vandervoort Ave on the south and Sweeney Ave on the west. April 23-1919 at 2.30 P.M. Meeting was called to order by Mr B. L. Rand and upon motion Mr W. H. Felton was chosen Secretary of meeting "Pro-tem." Lot owners present: B. L. Rand - Dr. J. R. Simson A. A. Bellinger - F. A. McCoy - Mrs B. L. Rand & W. H. Felton The following Trustees were elected for the ensuing three (3) years - Dr. J. R. Simson to succeede himself and Mr F. A. McCoy to succeede Mr E. H. Hewitt, our late Secretary. The Chairman reported a deposit in Erie County Savings Bank at Buffalo, N.Y. for 100.00 in the name of the Col John Sweeney Rural Association by "Nevin Neugent" the interest accruing on same to be used in taking care of the "Neugent Lot" in said Col. John Sweeney Rural Cemetery.

Considerable mention was made by members present of the deplorable condition into which the cemetery was falling and [special?] stress was brought upon the Trustees to see if something couldn't be done to improve the conditions even though the finances in the Treasury have gone down to almost nothing. The John Sweeney Rural Cemetery Association held a meeting yesterday afternoon at the Payne Avenue Church of Christ. Dr. John R. Simson was chosen a trustee to succeed himself and F. A. McCoy was elected to succeed the late Edwin H. Hewitt. The trustees then held a meeting at which B. L. Rand was elected president and Wilbur Felton was chosen secretary and treasurer. Plans were discussed for cleaning up the cemetery before Decoration Day and appointing a regular sexton. The co-operation of the lot owners will be sought. Aug-21-19 Special meeting of the Board of Trustees of the Col John Sweeney Rural Cemetery Assoc. held at "Payne Ave Church of Christ" No Tonawanda N.Y. on Thursday - Aug 21st 1919 at 2 o'clock in the Afternoon. Trustees present Mr B. L. Rand - Pres. Mr F. A. McCoy. Dr John R. Simson Mr W. H. Felton Sect & Treas. The meeting was called to order by the President Mr B. L. Rand who announced that the purpose of the special meeting was to draw up a suitable resolution to submit to the "heirs" of the Col John Sweeney Reservation Plot in the Col John Sweeney Rural Cemetery also to transact such other business as might be deemed necessary to come before it. The following resolution was presented by Mr Rand and Dr. Jno R. Simson moved for its adoption which was seconded by F. A. McCoy:- Whereas, by Chapter #229 of the Laws of 1914, Legislative permission has been granted to the City of North
Source 217Tonawanda to widen Thompson Street in said city so that the same shall, as widened, take 33 feet from the northerly side of the Col John Sweeney Rural Cemetery, and one of the conditions of said act is, that the bodies taken from that portion of said cemetery shall be re-intered in the same cemetery or elsewhere; and it is proposed by the heirs of Col. John Sweeney to deed to the Cemetery reserved for the purpose of burial to the heirs of said Col. John Sweeney, upon condition that the bodies so removed from Thompson Street as widened may be permitted to be intered in said tract by said Cemetery Association without expense for said land, the Cemetery Association to have the use of the remainder of said tract for other for other interments in said Cemetery; and and it has been requested that a condition be inserted in said deed of said heirs that the Cemetery Association keep in perpetual care and condition the Graves [Wording and repetitions retained as written, including the awkward clause beginning "to deed to the Cemetery".]

John Sweeney and his wife and the plot immediately surrounding the same in said cemetery, therefore Resolved that this Cemetery Association hereby consents and agrees that, in case said reserved tract is conveyed to this Association, it will, in consideration thereof perpetually so long as said Cemetery exists as a Cemetery, at its own cost and expense, care for and keep in neat and proper condition the graves therein of Col John Sweeney and his wife, and the plot of ground immediately surrounding the same. Motion was then made by Dr. John R. Simson and 2nded by Mr McCoy that $100.00 be set aside as an Endowment and placed in the Erie County Savings Bank of Buffalo N.Y. the interest (@4%) of which is to take perpetual care of the Col John Sweeney Lot and the ground immediately surrounding same - The $100.00 is to be taken from the sales of the 1st Lots sold in the Col John Sweeney Reserve Plot.
Source 219The Board gave Mr McCoy the authority and the necessary data to clean up the account of our late Secretary Mr Ed. H. Hewitt deceased and to report on same at the next meeting of the Board. The Treasurer reported the deposits of the check for 30.00 from Susan Rose and Maud K. World for $60.00 in the State National Bank of North Tonawanda - N.Y. also the deposits in the Erie County Bank Building of Bufo the $100.00 certificate of deposit as an Endowment to the care of the Wm H. Collins Lot (July 10th 1919). Motion was made by the President of the Board Mr Rand and Mr McCoy, that the Association is under no financial obligations to the Sexton - Mr Perry Barron - that in their talk with him Mr Barron stated the Association was clear of his books. Special meeting of Col. John Sweeney Rural Cemetery Association held at the City Hall Oct. 11, 1920 at 8 P.M. Present B. L. Rand, President and Trustee A. A. Bellinger, F. E. Atwood, Dr John R. Simson and F. A. McCoy. Also City Attorney James P. Lindsay. The President stated the object of the meeting was to take action relative to the widening of Thompson St. and any other matters pertaining to the association. In the absence of the Secretary F. A. McCoy was requested to perform the duties. Moved by F. A. McCoy and seconded by F. E. Atwood the adoption of the following resolution: That the deeds of the reserved section in Sweeney Cemetery of John R. Bryant and wife, James Sweeney Jr. and Louise Sweeney Ballard, Sarah Bryant Hanover by attorney, Geneva Thompson Potter and [Dorr?] Vrooman and Henry P. Smith as executors and trustees &c. to this Association be accepted upon the conditions stated in said deeds. Source 222which it shall be necessary to remove from that part of said cemetery needed for widening Thompson Street, said work to be done under the direction and supervision of the Cemetery Association, and that this Association will give the usual deeds or burial rights to the person or persons entitled thereto, to the plots assigned and in which said bodies are reinterred, if so desired. The above motion being put to a vote was duly carried. Attorney J. P. Lindsay tendered the above mentioned deeds which were accepted by the Association and returned to said Lindsay to be recorded in the County Clerk's office in Lockport. Moved by A. A. Bellinger that the piece of land deeded to the Association by the Sweeney heirs be plotted and that B. L. Rand and F. A. McCoy be a committee to arrange the survey and map of the same, also to arrange for the removal of all unnecessary trees. Carried. The President announced the resignation of W. H. The President reported that the sum of $98.00 had been turned in to him by sexton Perry Barron for the sale of lots and that the same had been deposited in the State National Bank to the credit of the Association. F. A. McCoy called attention to the balance due the Association from the estate of Edwin H. Hewitt amounting to $37.02 which sum was found due from him as former Secretary and Treasurer.
