**Notice of Pendency of Action**
Notice is Hereby Given, That an action has been commenced, and is now pending in the Supreme Court, upon the complaint of the above named plaintiff, against the above named defendants, filed in the Office of Clerk of the County of Niagara for the foreclosure of a mortgage, bearing date the First day of August, one thousand eight hundred and ninety-five, executed by Eugene De Kleist and Charlotte De Kleist, his wife, to William Ziemendorf, the plaintiff above named, and recorded in the Office of the Clerk of the County of Niagara, at Lockport, N.Y., on the Fifth day of September one thousand eight hundred and ninety-five, in Liber 242 of Mortgages, at page 514 at ten o’clock in the fore noon, and that the mortgaged premises in the last mentioned County, affected by the said action, were, at the time of the commencement thereof, and at the time of filing this notice, are situated in the City of North Tonawanda, in said County, and are described in the said mortgage as follows, to wit:
All that Tract or Parcel of Land Situate in the Village (now City) of North Tonawanda, County of Niagara and State of New York, being part of farm lot number twelve in the thirteenth township and eighth range of the Holland Purchase (so called), bounded as follows, to wit:
Beginning at a point in the middle of the Sawyers Creek Road where the middle line of Organ Avenue intersects the same, running thence westerly along the middle line of Organ Avenue two hundred sixty (260) feet; running thence at right angles to Organ Avenue, northerly one hundred forty (140) feet; running thence easterly on a line parallel to said middle line of Organ Avenue one hundred forty-five (145) feet to the middle line of the Sawyers Creek Road; running thence southeasterly along said middle line of Sawyers Creek Road one hundred seventy (170) feet to the place of beginning, according to a map showing subdivisions of part of said Lot twelve made for James Armitage, George C. Herschell and Allen Herschell by J. B. Snow, Civil Engineer, being the southeasterly portion of the premises conveyed by James Armitage and others to Eugene De Kleist, by deed bearing date January 1st, 1894, recorded in Niagara County Clerk’s Office June 19th, 1894 in Book 226 of Deeds page 532.
